Cook County Circuit Court Judge James McGing, allowed the Congress Theatre, 2135 N. Milwaukee, to remain open with restrictions at the Tues., Apr. 23, court hearing. The Congress is making progress on the 26 items in an injunction that could shut the popular music venue down. 

Progress on whittling down the City's violations punch list since the last court date included passing the inspections for the fire safety of the curtain and the ventilating system, said Roderick Drew, spokesperson for the City's Department of Law. 

While theatre owner Erineo "Eddie" Carranza wants to open the second and third floor balconies and increase their attendance to 5,300, the attendance restriction of 3,000 on the main floor and presence of fire guards are in effect for each show they will have prior to the next court date. 

Judge McGing set May 9 at 9:30 a.m. for next court date in Room 1111, Richard J. Daley Center. Carranza will be facing his Apr. 30 court date in front of the Chicago Liquor Commission. He'll be back at the Congress's next Deleterious Impact/Public Nusiance Ordinance Hearing with Chicago's Business Affairs and Consumer Protection Department (BACP) on May 7.

The Agreed Order:

1. Plaintiff's emergency motion for a preliminary injunction is entered and continued.
2. Defendant agrees not to allow occupancy to exceed 3,000 until further order of court.
3. Defendant agrees to keep unobstructed pathes of egress and provide 2 licensed fire gurards plus 1 stage fire guard.
4. Defendant agrees to keep all obstructions away from the fire curtain/stage block.
5. Defendant agrees to submit a certified balance report to the city and Dept. of Bld. Inspectors by May 9th 2013, for the ventilation system.

Specifically the preliminary injunction again the 2nd & 3rd floor shall remain in full force and effect, with exception for patrons to use 2nd floor bathrooms.
