Smith was originally appointed to the position when Annazette Collins was appointed to take over the State Senate seat because of the unexpected resignation of Ricky Hendon in 2011.

In March 2012 Smith was indicted for bribery and subsequently ousted from his State of Illinois 10th District State Representative seat in August 2012. According to prosecutors in the case Smith was heard on tape demanding that the $7,000 be paid in cash so there would be no trace of the money.

On the November 2012 ballot for the same seat from which he was ousted, Smith would not step down. A new party, the Unity Party, was formed to put someone else on the ballot.

In the interim, Eddie Winters, a sergeant in the Chicago Police Department, was appointed to fill the position.

Despite efforts to defeat him, in the November 2012 election, Smith won the election over Unity Party backed Lance Tyson.

Mid-December 2013, Smith's attorneys filed a motion to dismiss the corruption charges based on the "vagueness doctrine." This consistutional doctrine states that a law specifically states what conduct is illegal.

ABC's Chuck Goudie reported it this way...

Smith has repeatedly stated that people do not know the full story but they will. If this dismissal occurs, no one will ever hear his "full story."  It would appear that Smith could go through another election period without a resolution to accusations that started two years ago which caused him to be ousted by the Illinois House of Representatives 100 to 6.

Eddie Winters, who began his campaigning last year for the 10th District seat he briefly held, is facing accusations from a former alderman…another Smith, former 28th Alderman Ed Smith. Ed Smith is supporting Pamela Reaves-Harris, Winters filed a defamation suit against Ed Smith.

The redistricted 10th District now includes part of 9 aldermanic wards (1, 2, 24, 26, 27, 28, 32, 37 and 43). The 6 candidates running are Republican Mark Calonder and Democrates: Antwan D. Hampton, Beverly Perteet, Pamela Reaves-Harris, Derrick Smith (incumbent) and Eddie Winters. In November Calonder will be running against the Democrat who wins the primary.

Whether or not you live in the 10th District, you may want a chance to see American politics in action at BCO's meeting.
